NES That You Will Have to Comply With

If you are a national system employer, from 1 January 2010, there will be 10 National Employment Standards (or NES) that you will have to comply with. Each NES provides for minimum terms and conditions in the following areas:

  • maximum weekly hours;
  • requests for flexible working arrangements;
  • parental leave and related entitlements;
  • annual leave;
  • personal/carer’s leave and compassionate leave;
  • community service leave;
  • long service leave;
  • public holidays;
  • notice of termination and redundancy pay; and
  • the provision of the Fair Work Information Statement.

As you may or may not know, when the National Employment Standards (NES) come into effect on 1 January 2010, some employees will have a legal right to request flexible working arrangements.

Which employees will be able to make flexible work requests?

The employees that will have a legislated entitlement to request a change in their working arrangements under the NES are:

  • Employees who are parents or guardians of a child under school age
  • Employees who are parents or guardians of a disabled child up to 18 years of age
