NES That You Will Have to Comply With

If you are a national system employer, from 1 January 2010, there will be 10 National Employment Standards (or NES) that you will have to comply with. Each NES provides for minimum terms and conditions in the following areas:

  • maximum weekly hours;
  • requests for flexible working arrangements;
  • parental leave and related entitlements;
  • annual leave;
  • personal/carer’s leave and compassionate leave;
  • community service leave;
  • long service leave;
  • public holidays;
  • notice of termination and redundancy pay; and
  • the provision of the Fair Work Information Statement.

The New National Employment Standards Explained

Dear Reader,

On Monday June 16, Prime Minister Kevin Rudd and workplace relations minister Julia Gillard released the final version of the federal Labour government’s National Employment Standards.

What are the National Employment Standards?

The National Employment Standards (NES) will represent 10 minimum employment conditions that will become the minimum safety net for all Australian employees under the federal IR system. Along with modern awards, the NES will form an integral part of Labour’s new workplace relations system. The NES will be protected by the Workplace Relations Act.

What aspects of employment will they cover?

The 10 minimum conditions of employment covered by the NES will be:

  • maximum weekly hours of work
  • requests for flexible work arrangements
  • parental leave
  • annual leave
  • personal/carer’s leave and compassionate leave
  • community service leave
  • long service leave
  • public holidays
  • termination and redundancy pay, and
  • the right to be provided with the Fair Work Information Statement (this will be published by Fair Work Australia)

All other employment conditions will be provided for in new modern awards which are currently being constructed by the Australian Industrial Relations Commission (AIRC). For more information on awards, please refer back to Award Modernisation and What it Will Mean for Your Business.

When will the NES take effect?

Legislation bringing in the standards will be introduced later this year, but the NES will officially take effect from January 1, 2010.

What the NES will mean for you

As an employer in the federal system, you will have to ensure that your conditions of employment comply with the NES. For more information on the National Employment Standards and other changes to the industrial relations system please see our soon to be released update for your handbook!
