Q
Can we pay a new employee, who has commenced work on a probationary period, at a lower pay rate, and if they pass the probationary period their pay rate will increase?

A
There’s nothing stopping you from having a conversation with the employee about their rate of pay – and coming to an agreement. However, you cannot alter the remuneration of the employee without their consent – though it seems unlikely that an employee would not consent to having their pay increased.

If you want to get workers off-side with you and your business, muck up their pay!

If you want to keep workers happy and productive, get their pay right.

To help you achieve this happy balance, subscribe to the Employment Law Practical Handbook and read through the chapters on Probationary Employment (P5) and Wages (W1).

All chapters in the Handbook are written in plain English by the employment law experts at Holding Redlich so you know the advice you get is spot-on and easy to implement.
