As an employer, can we request that staff declare if they hold a second job?


No, not unless the second job:

  • conflicts with, or is in competition with, your enterprise or interests; or
  • affects an employee’s ability to perform their primary job or to meet their obligation to you.

Otherwise, there is no legal right to ask an employee about alternative employment.
