Can an offer of redundancy be retracted? In this instance, the letter of redundancy has gone out to the employee. However, it has been determined that the redundancy is a non-genuine redundancy (an error was made).

The employer has since retracted the redundancy and consulted with the employee, advising them of this error and that they are still required to perform the role with some minor changes, such as a change in job title. There have been no changes to remuneration, hours of work, location or reporting lines.


Yes, from a legal perspective an offer or notice of redundancy can be retracted prior to the termination if you have since determined there is a need for the role.
