When an employer pays its employees on a monthly basis, is there an obligation to pay on the same day of the month every month? If that date falls on a weekend, is there an obligation to pay employees on the working day prior to this?

Unless stated in an employment contract, award or agreement, there is no obligation to pay employees on the same day each month or to bring forward the date of payment if it falls on a weekend. However, you must ensure that payment of wages occurs at least monthly.

All employers’ responsibilities regarding staff payment are outlined in chapter W1 Wages of the Employment Law Practical Handbook.

Written in plain English by employment law experts, the Handbook provides detailed information on all areas of employment law.
