I have an employee who is starting a period of unpaid parental leave on a Tuesday, the day after a public holiday on the Monday. Is he entitled to be paid for the public holiday even though he does not work weekends and would have been starting his parental leave from the Monday if it were not a public holiday?
Yes, the employee is entitled to the public holiday. If he starts a period of unpaid parental leave on the Tuesday and he would normally work Monday to Friday, he would still be entitled to the Monday public holiday. If he started the period of unpaid parental leave on the Monday then he would not be entitled to receive payment for the public holiday as he would already be on unpaid leave.
