Your questions answered: Is there a standard disclaimer we can use for office drinks?

We propose to have drinks and nibbles once a month at our office. Beer and wine will be provided responsibly by the company.

However, we would like to have some sort of disclaimer signed by employees stating that they will be responsible for their behaviour. Is there any standard format for a disclaimer?

As your business has an overriding obligation under occupational health and safety legislation to provide a safe workplace, you cannot ask your employees to sign a disclaimer that waives your business’s liability.

However, there are a number of ways that you can minimise your legal exposure and fulfil your duty of care obligations to your employees.

For example, your business should have a workplace policy regarding drugs and alcohol.

Prior to the function, you should ensure that your employees have access to the policy, that they understand the policy and that they understand the business’s expectations regarding responsible consumption of alcohol.
