We are employing executive employees on part-time arrangements. Their arrangements include working from 9:30am to 2:30pm.

Please could you advise the calculation of ordinary hours for this? Should a paid or unpaid meal break be included?

If the employees are covered by an award or enterprise agreement, this instrument will dictate the hours. If not, the ordinary hours will be agreed between you and the employee, or if you don’t agree, will be the hours usually worked by these employees.

There is no specific requirement to provide breaks for award/agreement free employees with the exception that you have to adhere to workplace health and safety obligations.
