Company and director land in court over mining accident

Case

NSW Resources Regulator v Young Mining Company Pty Ltd; NSW Resources Regulator v Jhunjhunwala (2026)

Young Mining Company Pty Ltd owns and operates the Thuddungra Mine, an open-pit magnesite mine located approximately 29 kilometres north-west of Young in the South West Slopes region of New South Wales. For 70 years, the mine has extracted high-grade magnesium oxide products for agricultural, industrial and pharmaceutical use.

On 10 August 2021, a casual worker employed by YMC was investigating a blockage when he fell headfirst into an unguarded chute leading to a conveyer belt on a Photometric Plant (the PM). The worker pulled an emergency stop lanyard, but the machine continued to operate. He became partially buried by the material being fed into the chute, and suffered a serious crush injury to the right side of his chest, fractured ribs and a lumbar spine injury.
