Flexible work arrangements can be inconsistent with terms of enterprise agreements
Case
Paper Australia Pty Ltd trading as Opal Australian Paper v Anthony May (2025)
In 2024, Paper Australia Pty Ltd, trading as Opal Australian Paper (Paper Australia), wrote to its employees, including Mr May, advising that flexible work arrangements would cease as they were not compliant with the start and finish times in the enterprise agreement.
Mr May requested to formalise his long-standing informal flexible work arrangement, which had been in place since 2011. This involved variable start and finish times to enable him to drop off and pick up his children from school.
