A National Disability Insurance Scheme provider, Support People Pty Ltd (SPPL), employed Ms Poulton as a Compliance and Risk Officer. Ms Poulton worked on a permanent part-time basis, 4 days per week, with 3 days worked remotely and 1 day in the office. SPPL made a decision to outsource its payroll and human resources functions, making Ms Poulton’s position redundant.

SPPL offered Ms Poulton an alternative role that:

  • had reduced responsibilities;
  • involved working only 2 days per week, thereby reducing her salary; and
  • could not be performed remotely.
