Manufacturer prosecuted for employee’s bullying of apprentice

WorkSafe Victoria v Elite Windows (Vic) Pty Ltd (2026)
Over the course of 8 months, an apprentice joiner of window and door manufacturer Elite Windows (Vic) Pty Ltd was a victim of bullying and harassment by a qualified joiner. The qualified joiner’s behaviour included calling the apprentice names, recording the times of the apprentice’s bathroom breaks, deliberately bumping the apprentice, and threatening the apprentice, including inciting him to fight.
Verdict
The Court found that Elite Windows had failed to:
- reduce the risk to the mental and/or physical health and safety of employees posed by bullying; and
- provide and maintain a safe system of work.
