Williams v Mind Matters Sydney Pty Ltd (2026)

Mr Williams, a psychologist at Mind Matters Sydney Pty Ltd (Mind Matters), bought an application in the Fair Work Commission (FWC) alleging his employment had been terminated in breach of the general protection provisions of the Fair Work Act 2009 (Cth) (FW Act).

Mind Matters raised a jurisdictional objection that Mr Williams was not dismissed because he was an independent contractor, not an employee, and the termination had not been for a prohibited reason, but rather because Mr Williams was not the “right fit for its business”.
