Testing the consecutive maximum-term contracts provisions

Case

Ong v Victorian Energy Safety Commission & Anor (2025)

The Victorian Energy Safety Commission (VESC) employed Ms Ong under three consecutive maximum-term contracts:

  1. From 5 April 2023 to 6 March 2024 as People Services Business Partner (later changed to HR Business Partner).
  2. From 29 February 2024 to 30 June 2024 as HR Business Partner.
  3. From 1 July 2024 to 31 December 2024 as Senior HR Business Partner.

After the third contract ended, Ms Ong commenced general protection proceedings involving dismissal in the Fair Work Commission (FWC), claiming that VESC took adverse action against her by terminating her employment.
