Can we withhold notice pay if an employee refuses to work their notice period?
Q: One of our employees resigned to go to another role. He gave his required 4 weeks’ notice for the resignation. However, he then applied for unpaid leave for the last 2 weeks of the notice. We discovered this was so he could begin in his new role. We are not going to approve the unpaid leave request and will require him to work out his notice period. If the employee simply doesn’t return to work the full notice period, can the 2 remaining weeks of the notice period be withheld from his final pay?
