AI and the workplace
New chapter, July 2026
This chapter examines the use of AI in human resource management functions and how to manage the potential legal risks of this usage.
What is AI?
Definition: AI
AI, or artificial intelligence, means a machine-based system that infers from the input it receives how to generate content, recommendations or other outputs. These inputs are referred to as training data. The AI system applies machine learning algorithms to a set of training data to develop a model that is able to draw inferences or make decisions.

AI systems vary in their levels of autonomy and adaptiveness after deployment. AI includes:
- Generative AI (GenAI): Software systems that generate content such as text and images based on a user’s prompts.
- Public AI: AI tools that are openly accessible to the public, typically via the internet, and are trained on broad, often public datasets, most commonly for general purpose use.
- Closed AI: AI tools that are generally not openly accessible to the public and use information that remains within a controlled environment.
